Professional Partner Terms

1. Accurate and Authorized Profiles

You represent that you are authorized to act for the listed business and that all profile, license, service-area, contact, team, website, review, and promotional information is accurate, current, lawful, and not misleading. You must promptly update material changes.

2. Licenses, Insurance, and Legal Compliance

You are solely responsible for maintaining every license, registration, permit, bond, insurance policy, disclosure, supervision requirement, and professional standard applicable to your services and locations. You must comply with consumer-protection, advertising, telemarketing, email, privacy, fair-housing, antidiscrimination, lending, insurance, real estate, moving, transportation, and other applicable laws. Moving Smart USA does not authorize work outside your lawful scope.

3. Independent Businesses

Partners are independent businesses, not employees, agents, joint venturers, franchisees, or representatives of Moving Smart USA. You control your services, prices, contracts, schedules, personnel, taxes, and legal compliance. You may not claim that Moving Smart USA guarantees, employs, licenses, or endorses you.

4. Plans and Matching Eligibility

The free Starter plan provides one service city, a basic profile, limited directory placement, no CRM, and basic statistics. Starter profiles are not provided to customers through questionnaire matching and do not receive customer personal information. Starter partners may receive a non-identifying notice that demand exists for a service category in a listed city.

Pro and Team plans may be eligible for priority matching, enhanced placement, CRM features, statistics, and other displayed benefits. Eligibility does not guarantee selection, visibility, leads, contacts, transactions, revenue, exclusivity, or any particular search position. Matching may depend on service, city, plan, account status, customer request, system rules, rotation, availability, and other legitimate factors.

5. Customer Information and Consent

You may receive customer personal information only when Moving Smart USA indicates that the customer consented to sharing or when the customer contacts you directly. Use customer information solely to respond to the relevant request and provide requested services. Do not sell, resell, trade, post, scrape, append to unrelated lists, or disclose it except to personnel and service providers who need it for the authorized purpose and are subject to appropriate confidentiality and legal duties.

You must honor opt-out, do-not-contact, deletion, correction, and other applicable privacy requests; use reasonable security; restrict access; and delete information when no longer reasonably needed. Customer consent to sharing is not consent to unlimited marketing, robocalls, prerecorded messages, or communications prohibited by law.

6. Professional Conduct

Communicate honestly and respectfully. Do not harass, pressure, discriminate, misrepresent urgency, guarantee outcomes you cannot control, submit fabricated reviews, engage in bait-and-switch pricing, or use deceptive credentials. Provide legally required agreements, disclosures, estimates, cancellation rights, and notices directly to customers.

7. Fees, Renewals, and Cancellation

Current prices and billing intervals are shown at checkout. Paid plans renew automatically until cancelled. Annual pricing may reflect the advertised savings compared with monthly billing. Stripe or another disclosed processor handles payment information. You authorize recurring charges for the selected plan until cancellation takes effect.

Cancel paid billing through the billing portal or other provided cancellation method. Deleting a profile does not itself cancel an active paid subscription. Unless required by law or expressly stated, fees already charged are nonrefundable. Plan changes, promotions, taxes, failed payments, and prorations may be handled under checkout terms and payment-provider rules.

8. Profile Content

You retain ownership of content you submit and grant Moving Smart USA a nonexclusive, worldwide, royalty-free license to host, reproduce, resize, format, display, distribute, and use it to operate and promote your profile and the service. You represent that you own or have permission to use all names, logos, photographs, text, links, and other submitted materials.

9. Monitoring, Removal, and Account Action

We may review, correct formatting, request documentation, limit, suspend, or remove profiles or access based on inaccurate information, complaints, safety concerns, expired credentials, nonpayment, unlawful conduct, misuse of customer data, reputational risk, or violation of these Terms. We are not required to mediate customer disputes.

10. No Guaranteed Results

Moving Smart USA makes no guarantee about traffic, impressions, profile views, matches, customer consent, lead quality, response, closing rate, transaction value, or revenue. Statistics may be delayed, incomplete, affected by technical limitations, or limited to activity measurable on the website.

11. Disclaimers, Liability, and Indemnity

The disclaimers and liability limits in the Terms of Use apply. To the extent permitted by law, you will defend, indemnify, and hold Moving Smart USA harmless from third-party claims and reasonable expenses arising from your profile, services, communications, personnel, contracts, legal noncompliance, misuse of information, or infringement of another person’s rights.

12. Changes and Contact

We may update these Partner Terms by posting a revised effective date and providing additional notice when appropriate. Continued participation after an update constitutes acceptance to the extent permitted by law. Questions may be sent to info@movingsmartusa.com.
