1. Eligibility

You must be at least 18 years old and legally able to enter agreements to create an account, purchase a membership, or request professional services through the website.

2. What Moving Smart USA Provides

Moving Smart USA operates an informational relocation website and professional directory. We may help customers identify independent professionals whose listed services and service areas appear relevant to a request. Moving Smart USA is not itself a moving company, real estate brokerage, mortgage lender, insurance agency, storage provider, apartment locator, contractor, inspector, property manager, law firm, financial adviser, or other listed professional service provider.

Unless expressly stated, Moving Smart USA does not employ, control, supervise, endorse, guarantee, or independently verify every professional, license, credential, background, insurance policy, statement, price, availability, or service. A profile, badge, priority position, or match is not a warranty or endorsement.

3. Customer Responsibility

You decide whether to contact or hire a professional. Before hiring, independently verify identity, licenses, insurance, registrations, references, reviews, complaints, estimates, contracts, and suitability. Obtain written terms and consult qualified legal, tax, financial, real estate, insurance, or other advisers when appropriate. Moving Smart USA is not a party to agreements between customers and professionals and is not responsible for their conduct, work, payment disputes, property damage, delays, injuries, omissions, or representations.

4. Information Sharing

Your information is handled under our Privacy Policy. Checking the questionnaire information-sharing box authorizes Moving Smart USA to send submitted contact information and relevant request details to eligible matched paid professionals, who may contact you. If you do not check the box, your personal information is not sent to professionals through questionnaire matching. You are never obligated to hire a recommended professional.

5. Accounts

You are responsible for accurate account information, a secure password, and activity under your account. Notify us promptly of suspected unauthorized access. Do not impersonate another person, create deceptive profiles, or use contact information without authority.

6. Acceptable Use

You may not misuse the website; scrape or harvest personal information; send spam; introduce malware; interfere with security or operation; reverse engineer restricted features; submit unlawful, deceptive, discriminatory, defamatory, infringing, or harmful content; create fraudulent requests or profiles; or use customer information for purposes unrelated to the customer’s request.

7. Intellectual Property and Submitted Content

The website, branding, layout, text, graphics, software, and original content are owned by or licensed to Moving Smart USA and protected by applicable law. You may use the website for personal or authorized business purposes but may not copy, sell, republish, or exploit it without permission.

You retain ownership of content you submit. You grant Moving Smart USA a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and use that content as reasonably necessary to operate and promote the website and your public profile. You represent that you have the rights needed to submit it.

8. Third-Party Services

Payments and some website functions are provided by third parties such as Stripe, hosting, email, mapping, review, and professional websites. Their terms and policies may apply. We are not responsible for third-party websites, products, or services.

9. No Guarantee of Availability or Results

We do not guarantee uninterrupted access, error-free operation, a particular number of professionals, matches, leads, contacts, customers, transactions, response times, search position, revenue, or business results. We may modify, suspend, or discontinue features when reasonably necessary.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” Moving Smart USA disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and any warranties arising from course of dealing or usage. Some jurisdictions do not allow certain disclaimers, so portions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Moving Smart USA and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or business; or damages arising from independent professionals, customers, third parties, or reliance on website content. Where liability cannot be excluded, aggregate liability relating to the website will not exceed the greater of $100 or the amount you paid directly to Moving Smart USA during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Moving Smart USA harmless from third-party claims, losses, and reasonable expenses arising from your unlawful use, submitted content, violation of these Terms, or violation of another person’s rights.

13. Suspension and Termination

We may restrict or terminate access for fraud, misuse, nonpayment, safety concerns, legal requirements, or material violations of these Terms. You may stop using the website at any time. Account or profile deletion does not automatically cancel an active paid subscription unless cancellation is completed through the applicable billing process.

14. Governing Law and Venue

These Terms are governed by Nevada law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes must be brought in state or federal courts serving Clark County, Nevada. Before filing a claim, the parties agree to make a good-faith attempt to resolve it by contacting info@movingsmartusa.com.

15. Changes and Contact
